1. Acceptance of Terms

By downloading, installing, or using Shrinkpad ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software. We reserve the right to update these Terms at any time, and your continued use of the Software constitutes acceptance of any changes.

2. License Grant

Upon purchase, Shrinkpad grants you a non-exclusive, non-transferable, perpetual license to use the Software subject to these Terms.

License Types

• Free Starter: Limited functionality license for personal use on unlimited devices. Subject to feature restrictions as described on our website.
• Personal License: One-time purchase granting a lifetime license for use on one (1) device. This license is tied to you as an individual and may be transferred to a new device if you replace your computer.
• Team License: One-time purchase granting a lifetime license for use on up to ten (10) devices. Suitable for small teams or individuals with multiple workstations.

Lifetime License Definition

"Lifetime license" refers to the lifetime of the Software product, not the lifetime of the purchaser. This means:

• You have perpetual access to the version of the Software you purchased, including all minor updates and bug fixes for that major version
• Major version upgrades (e.g., from version 1.x to 2.x) may require an additional purchase at a discounted rate for existing customers
• The license remains valid for as long as the Software continues to function on your system

Discontinuation of Software

We reserve the right to discontinue, modify, or stop developing the Software at any time, for any reason, without prior notice. In the event that:

• The Software is removed from distribution (e.g., removed from the Mac App Store or our website)
• Development or support for the Software is discontinued
• The Software becomes incompatible with future operating system updates
• We cease business operations

You are not entitled to any refund, credit, or compensation. Your license grants you the right to use the Software as it exists at the time of purchase and any updates provided thereafter, but does not guarantee continued availability, development, support, or compatibility with future systems.

We recommend downloading and keeping a local copy of the Software installer for your records, as we cannot guarantee future availability of downloads.

3. Restrictions

You may not:

• Copy, modify, or distribute the Software
• Reverse engineer, decompile, or disassemble the Software
• Rent, lease, lend, sell, or sublicense the Software
• Use the Software in any way that violates applicable laws
• Remove or alter any proprietary notices on the Software
• Share your license key with others or use it on more devices than permitted

4. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

We do not warrant that:

• The Software will meet your specific requirements
• The Software will be uninterrupted, timely, secure, or error-free
• The results obtained from the Software will be accurate or reliable
• Any errors in the Software will be corrected

5. Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT SHRINKPAD AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Data Loss: Any loss, corruption, or damage to your files, images, videos, or any other data, whether during compression or otherwise
• Loss of Profits: Any loss of profits, revenue, or business opportunities
• Device Damage: Any damage to your computer or other equipment
• Third-Party Claims: Any claims brought against you by third parties

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

You are solely responsible for maintaining backups of your files. We strongly recommend backing up any files before processing them with the Software.

6. Indemnification

You agree to indemnify, defend, and hold harmless Shrinkpad and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Software or violation of these Terms.

7. Refund Policy

We offer a 7-day money-back guarantee from the date of purchase, no questions asked. If you are not satisfied with the Software for any reason, you are entitled to a full refund within this period.

How to Request a Refund

To request a refund, send an email to support@shrinkpad.app within 7 days of your purchase. Please include the following information:

• Your email address used for the purchase
• Date of purchase
• Order number or transaction ID (if available)

Refunds are typically processed within 5-7 business days. The refund will be credited to the original payment method.

After the Refund Period

After 7 days, all sales are final. No refunds will be issued for:

• Requests made after the 7-day refund period
• Discontinuation or removal of the Software from distribution
• Incompatibility with future operating system updates
• Changes to features or functionality
• Cessation of development or support
• Any circumstances beyond the 7-day satisfaction guarantee period

8. Updates and Support

We may release updates to the Software from time to time. While we strive to maintain and improve the Software, we are not obligated to provide updates, support, or maintenance. Priority support is available for Team license holders as described on our website.

9. Termination

We may terminate your license immediately if you breach any provision of these Terms. Upon termination, you must cease all use of the Software and destroy all copies in your possession. Sections 4, 5, 6, and 10 shall survive any termination of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Shrinkpad operates, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

12. Entire Agreement

These Terms constitute the entire agreement between you and Shrinkpad regarding the use of the Software and supersede all prior agreements and understandings, whether written or oral.
